We understand that your personal information is important to you, and we value your trust.
- Who we are?
This privacy policy discloses the privacy practices of QCONZ Ltd in relation to the Locate App and Website.
The Locate App processes data submitted by the customer and their users for the purpose of providing mobile location services to customers. The Locate App is used by our customers to ensure their employees are in safe location at all times, and to keep in touch with team members out in the field. The app requires location access to be able to transmit the user location at regular intervals. This is required for the system to function.
This policy sets out how we handle location information and other personal information collected by the Locate App and Website.
We are bound by the Privacy Act 2020 (“Privacy Act”) and all supporting regulations.
- What personal information do we collect about you?
When you use the Locate Website or App, we may collect your personal information. The types of personal information we collect from you depends on the features you use.
App User information:
While Locate customers and their users decide what data to submit, the Locate App typically collects the following personal information about users:
- name, mobile phone number, email address, home address, group association, emergency contact.
- mobile phone GPS location and history
Locate Customer information:
The personal information that we may collect about customers includes:
- Purchase Information: We may collect your name, billing address, email address, telephone number, credit card number and expiration date when you make a purchase. This information is used to provide the products and services that you have ordered or requested, to process and to send order confirmations (or other transactional information) and/or to provide customer service.
- Account Information: We may collect your name, email address, mailing address, post code, if you create an account with us. This information will be used to help you keep track of your orders, to keep you updated about special offers, updates related to the Sites, and to facilitate checkout during purchases.
- Information for Commercial Communications: We may collect your name, email address, mailing address, gender, and birth date if you sign up to receive promotional emails from us. This information may be used to contact you about sales, special offers and new features available through the Sites.
Information Relating to Inquiries: We may collect your name and email address if you contact us with a question. This information may be used so that we can respond to your question.
- What are the purposes for which the Locate App collects, holds, uses, and discloses your information?
The Locate app collects personal location information in order to fulfil its intended purpose of providing mobile user GPS location data to customers to ensure the health and safety of their employees, and for work scheduling and efficiency gains. This information is required for the system to function.
To fulfil this purpose, we may access the data to provide the service, to correct and address technical or service problems, or to follow instructions of the Locate customer whose users have submitted the data, or in response to contractual requirements.
We also collect personal information from our customers via the website so we can respond to customer queries and/or to complete the purchase process.
- How do we collect your information?
Mobile phone location data is transmitted via the Locate mobile phone app to the Locate web dashboard via the Automatic Status Update features. These features will collect information on GPS location of a user for the purpose of updating the location status. Location data, such as latitudes and longitudes are collected during operating hours specified by the customer and are stored.
We collect customer information from via customer enquiry forms submitted via the website and the online customer purchase process.
We also collect personal information from our customers via the website so we can respond to customer queries and/or to complete the purchase process.
- What information do we collect automatically?
Once you install the Locate App on your mobile phone and log in, mobile location technology automatically collects and transmits your mobile location data at regular intervals.
Whenever an individual visits or interacts with a QCONZ website or online platform
(“Platforms”), we, as well as any third-party service provider and/or advertiser, may use a variety of technologies that automatically or passively record information about how the Platform is accessed and used (“Usage Information”). Usage Information may include IP address or other unique identifier for the device used to access a Platform (“Device Identifier”), browser type, “Device” type (computer, mobile phone, tablet, or other device), operation system, application version, date and time of visit, pages viewed, preceding page views and use of features or applications on the Platform such as interactions with connections or groups.
Usage Information helps us keep QCONZ owned Platforms relevant to users and allows us to tailor content to a user’s interests. Usage Information is generally non-identifying, but if we associate it with a specific and identifiable person, we will treat it as personal information.
We may use Device Identifiers to help us administer Platforms, diagnose problems with our servers, analyse trends, observe Platform usage and activity over time, help identify individuals and their shopping cart, and gather broad demographic information for aggregate use.
Cookies (data files placed on a Device when it is used to visit a Platform) may be used to
associate individuals with social media platforms like Facebook and, if chosen, enable
interaction between activities on our Platforms and those social media platforms. We or our vendors may place cookies on an individual’s Device for security purposes, to facilitate site navigation and personalise experience while visiting our Platforms (such as allowing us to select which ads or offers are most likely to appeal, based interests, preferences, location, or demographic information).
- Sharing of personal information
App user:
We do not share personal information about users. The Locate service is purchased by the Employer of the Users, and all location data and personal information collected is stored and may be shared by the Users’ Employer only via the locate mobile and web dashboard.
Only employers and their designated staff who have been given access permission can view and share this information.
We do not sell, trade, or otherwise transfer your personally identifiable information to outside parties, without your consent, other than for the express purpose of delivering the purchased service requested or billing for that service.
We do not have any relationship with Users with whom their Employers add to their Locate account. Here, the Employer(s) are responsible for ensuring that Users are provided with appropriate notice and choice with respect to their personal data being collected and shared. The User will need to read their Employers Privacy Policy to understand how their personal information is handled by them.
Locate customer:
We only use or disclose customer information as follows:
a)To third parties where we have retained those third parties to assist us to:
– prevent and resolve unauthorised access to, or attacks on QCONZ Systems; or
– to provide the product or service you have requested, so long as those parties agree to keep the information confidential;
- b) for direct marketing of products or services; or
- c) where otherwise legally permitted were we may release your information to government and law enforcement agencies, bodies and regulators, or a dispute resolution body if we are required to disclose your information to such authorities in order to meet our obligations under law.
By providing us with your email address you consent to receiving emails from us advising of updates, and products and services available. You may unsubscribe from our email database at any time.
- How do we secure/ protect your personal information?
All information is securely stored on the QCONZ server. We take reasonable steps to protect your information from misuse, loss, interference, and from unauthorised access, modification, or disclosure.
Some the ways we protect your information:
- we implement a variety of security measures to maintain the safety of customer personal information when you place an order or enter, submit, or access your personal information.
- offering our customers the use of a secure server. All supplied credit information is transmitted via Secure Socket Layer (SSL) technology and then is only accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.
- storing information entered on website in encrypted files such as Secure Socket Layer (SSL) protocol.
- utilising and maintaining information security applications to prevent unauthorised access or damage to electronically stored information, such as requiring identifiers and passwords, firewalls, and anti-virus software.
- data is backed up periodically to avoid loss during any hardware or software failure events. These backups may contain information that has since been deleted from the Locate system. Our data backups are themselves deleted after 30 days.
- How long do we retain your personal information?
Personal information is only retained if we need it for the purposes for which it was originally collected (or to which you have subsequently consented), for other legitimate purposes (such as regulatory compliance) and as permitted or required by applicable laws.
An individual may request the deletion of any account information by contacting us using our contact details set out at the bottom of this policy. QCONZ will delete the personal information it holds (unless we need to retain it for the purposes set out in this Privacy Policy).
- How long can you access and correct your personal information we hold?
Any individual has the right to access and ask us to correct any inaccurate personal information held and may reviewed or corrected on request. Please contact us using the details set out at the bottom of this privacy policy.
Accessing information may be refused in a few circumstances, such as where the information relates to anticipated legal proceedings. If we deny or restrict access, we will contact individuals to let them know why, unless, having regard to the grounds for the refusal, it would be unreasonable for us to do so. Any individual may make a complaint about a refusal to the Office of the Privacy Commissioner.
We rely on the information that we hold to provide this service, and ensure it functions correctly. Therefore, it is very important that the information we hold is accurate, complete, up to date, and relevant. This means that, from time to time, we may ask if information is still accurate and up to date. If any information that we hold is incorrect, individuals should contact us immediately and we will take reasonable steps to correct it.
While Locate will aid in exporting data free of charge for our customers, we do reserve the right to charge a fee for excessive data access requests numbering more than three per year.
As a User , your Employer is the first point of contact who will access and correct your personal information on the Locate system they have purchased and operate.
- Complaints Resolution
If an individual believes that their privacy has been compromised, or feels that we have breached the privacy laws, they are entitled to make a complaint. Complaints can be made by contacting the relevant person or department or by contacting us using our contact details set out at the bottom of this policy.
We endeavour to respond within 24 hours to acknowledge the complaint and explain how we will investigate it. We will try to resolve complaints within 20 working days and in writing to explain the reasons for our decision. When this is not possible, QCONZ will be in contact with a revised timeframe.
